Whose Fault Is It?

Defects in design, workmanship, or materials are no laughing matter, especially when the end result is serious injury or even death. If you are injured due to a defective product, is the manufacturer responsible?  <Full Story>

Black Boxes

Beginning in the early 1990’s, trucking manufacturers started incorporating “Black Boxes” into engines to capture information about the driver’s operation of the truck. No longer do we have to take the truck driver’s word for what happened when an accident occurs. <Full Story>

Workers’ Compensation benefits are limited by statute and often do not adequately compensate injured workers for the disability their injuries create. An injured worker can receive a maximum of 500 weeks of compensation for permanent and total disability in SC. That is a little less than 10 years of disability benefits. So whether someone is 25 years old or 65 years old if it is determined that they are unemployable because of their injuries they are entitled to less than 10 years of benefits under Workers’ Compensation.

Helping personal injury victims in South Carolina
and throughout the Southeastern United States

Our lawyers have high profile, real world experience handling claims related to motor vehicle and work-related accidents, as well as a wide range of other personal injury cases. Mark Chappell, a partner at Chappell, Smith & Arden, was appointed the lead plaintiff’s liaison counsel in the Graniteville train disaster cases pending before Judge Margaret B. Seymour in U.S. District Court in Columbia, South Carolina. The January 6, 2005 train derailment and chlorine gas spill in Graniteville, South Carolina adversely affected thousands of local residents and employees. Mark was also appointed to the legal steering committee following the May 2000 bridge collapse at the Lowe’s Motor Speedway. Chappell, Smith & Arden coordinated all documents and discovery, depositions, and the resources of the 24 law firms representing the 87 race fans injured during the collapse.

Bill Smith and Mark Arden also have 45 years of combined experience handling worker’s comp cases.  Both attorneys limit their practices to workers’ comp and represent injured workers daily before the South Carolina Workers’ Compensation Commission. Each serves or served on virtually every board and committee of workers compensation-related organizations on behalf of injured workers.

Did You Know?

South Carolina has the fourth largest state-maintained system in the country; which consists of Interstates, U.S. highways, state highways, and secondary roads, totaling approximately 41,500 miles. South Carolina's primary interstates include I-20. I-26, I-77, I-85 and I-95. Add to that list I-126, I-185, I-326, I-385, I-520, I-526 and I-585 and you can see why there are so many motor vehicle accidents each year in our state.

Major trucking companies love to use our highways and plentiful railway facilities, booming ports and airports. Approximately 130 truck lines and 150 motor freight lines operate in South Carolina. Have you seen these trucks on our highways?

UPS, FedEx, JB Hunt, Con-Way, Swift, Landstar, Old Dominion, Southeastern, Estes, R+L Carriers, Saia, Averitt. AAA Cooper or C.R. England?  Chances are good you answered "Yes" to more than one of those big names. And chances are you or someone you know will be involved in an accident with a truck at some point.
